"وإذا تزوج العبد بغير إذن مولاه فقال المولى طلقها أو فارقها فليس هذا بإجازة" لأنه يحتمل الرد لأن رد هذا العقد ومتاركته يسمى طلاقا ومفارقة وهو أليق بحال العبد المتمرد أو هو أدنى فكان الحمل عليه أولى
