"فإن حلف على أقل من أربعة أشهر لم يكن موليا" لقول ابن عباس رضي الله عنه لا إيلاء فيما دون أربعة أشهر ولأن الامتناع عن قربانها في أكثر المدة بلا مانع وبمثلة لا يثبت حكم الطلاق فيه
