"ومن حلف لا يتزوج أولا يطلق أولا يعتق فوكل بذلك حنث" لأن الوكيل في هذا سفير ومعبر ولهذا لا يضيفه إلى نفسه بل إلى الآمر وحقوق العقد ترجع إلى الآمر لا إليه
