"ولو حلف لا يضرب عبده أو لا يذبح شاته فأمر غيره ففعل يحنث في يمينه" لأن المالك له ولاية ضرب عبده وذبح شاته فيملك تولية غيره ثم منفعته راجعة إلى الآمر، فيجعل هو مباشرا إذ لا حقوق له ترجع إلى المأمور
