"وحد الخمر والسكر في الحر ثمانون سوطا" لإجماع الصحابة رضي الله عنهم "يفرق على بدنه كما في حد الزنا على ما مر" ثم يجرد في المشهور من الرواية وعن محمد رحمه الله أنه لا يجرد إظهارا للتخفيف لأنه لم يرد به نص ووجه المشهور أنا أظهرنا التخفيف مرة فلا يعتبر ثانيا
