"فإن باشر القتل أحدهم أجرى الحد عليهم بأجمعهم" لأنه جزاء المحاربة وهي تتحقق بأن يكون البعض ردءا للبعض حتى إذا زلت أقدامهم انحازوا إليهم وإنما الشرط القتل من واحد منهم وقد تحقق.
