"أخذ شيئا وخرج به ملكه ملكا محظورا" لورود الاستيلاء على مال مباح إلا أنه حصل بسبب الغدر فأوجب ذلك خبثا فيه فيؤمر بالتصدق به وهذا لأن الحظر لغيره لا يمنع انعقاد السبب على ما بيناه.
