قال: "وأرض السواد مملوكة لأهلها يجوز بيعهم لها وتصرفهم فيها" لأن الإمام إذا فتح أرضا عنوة وقهرا له أن يقر أهلها عليها ويضع عليها وعلى رءوسهم الخراج فتبقى الأراضي مملوكة لأهلها وقد قدمناه من قبل.
