"وعن محمد أنه لا يباع ولا يورث ولا يوهب" اعتبره مسجدا، وهكذا عن أبي يوسف أنه يصير مسجدا؛ لأنه لما رضي بكونه مسجدا ولا يصير مسجدا إلا بالطريق دخل فيه الطريق وصار مستحقا كما يدخل في الإجارة من غير ذكر.
