قال: "ومن باع عينا على أن لا يسلمه إلى رأس الشهر فالبيع فاسد" ؛ لأن الأجل في المبيع العين باطل فيكون شرطا فاسدا، وهذا؛ لأن الأجل شرع ترفيها فيليق بالديون دون الأعيان.
