"فإن هلك بعض المبيع جازت الإقالة في الباقي" ؛ لقيام البيع فيه،

وإن تقايضا تجوز الإقالة بعد هلاك أحدهما ولا تبطل بهلاك أحدهما لأن كل واحد منهما مبيع فكان المبيع باقيا، والله أعلم بالصواب.
