"ولو انقطع بعد المحل فرب السلم بالخيار، إن شاء فسخ السلم، وإن شاء انتظر وجوده" لأن السلم قد صح والعجز الطارئ على شرف الزوال فصار كإباق المبيع قبل القبض.
