"إن لم يطأها فليس بقبض" والقياس أن يصير قابضا؛ لأنه تعييب حكمي فيعتبر بالتعييب الحقيقي. وجه الاستحسان أن في الحقيقي استيلاء على المحل وبه يصير قابضا ولا كذلك الحكمي فافترقا.
