قال: "ومن أخذ من رجل كفيلا بنفسه ثم ذهب فأخذ منه كفيلا آخر فهما كفيلان" لأن موجبه التزام المطالبة وهي متعددة والمقصود التوثق، وبالثانية يزداد التوثق فلا يتنافيان
