قال: "ولا يجوز تعليق البراءة من الكفالة بالشرط" لما فيه من معنى التمليك كما في سائر البراءات. ويروى أنه يصح لأن عليه المطالبة دون الدين في الصحيح فكان إسقاطا محضا كالطلاق، ولهذا لا يرتد الإبراء عن الكفيل بالرد بخلاف إبراء الأصيل.
