قال: "فإن ادعى رقبة العبد فكفل به رجل فمات العبد فأقام المدعي البينة أنه كان له ضمن الكفيل قيمته" لأن على المولى ردها على وجه يخلفها قيمتها، وقد التزم الكفيل ذلك وبعد الموت تبقى القيمة واجبة على الأصيل فكذا على الكفيل، بخلاف الأول.
