"وصفة الإشهاد أن يقول شاهد الأصل لشاهد الفرع: اشهد على شهادتي أني أشهد أن فلان بن فلان أقر عندي بكذا وأشهدني على نفسه" لأن الفرع كالنائب عنه فلا بد من التحميل والتوكيل على ما مر، ولا بد أن يشهد كما يشهد عند القاضي لينقله إلى مجلس القضاء
