"وإن شهدا بالمال ثلاثة فرجع أحدهم فلا ضمان عليه" لأنه بقي من بقي بشهادته كل الحق، وهذا لأن الاستحقاق باق بالحجة، والمتلف متى استحق سقط الضمان فأولى أن يمتنع
