قال: "فإن وكل وكيلا يقبض ماله فادعى الغريم أن صاحب المال قد استوفاه فإنه يدفع المال إليه" لأن الوكالة قد ثبتت والاستيفاء لم يثبت بمجرد دعواه فلا يؤخر الحق.
