قال: "وللمعير أن يرجع في العارية متى شاء" لقوله عليه الصلاة والسلام : "المنحة مردودة والعارية مؤداة" ولأن المنافع تملك شيئا فشيئا على حسب حدوثها فالتمليك فيما لم يوجد لم يتصل به القبض فيصح الرجوع عنه.
