"ومن استأجر دابة ليسافر عليها ثم بدا له من السفر فهو عذر" ؛ لأنه لو مضى على موجب العقد يلزمه ضرر زائد؛ لأنه ربما يذهب للحج فذهب وقته أو لطلب غريمه فحضر أو للتجارة فافتقر
