قال: "وإن كاتبه على ألف إلى سنة وقيمته ألفان ولم تجز الورثة يقال له أد ثلثي القيمة حالا أو ترد رقيقا في قولهم جميعا" لأن المحاباة هاهنا في القدر والتأخير فاعتبر الثلث فيهما. [
