قال: "وإذا عجز المكاتب عاد إلى أحكام الرق" لانفساخ الكتابة "وما كان في يده من الأكساب فهو لمولاه" لأنه ظهر أنه كسب عبده، وهذا لأنه كان موقوفا عليه أو على مولاه وقد زال التوقف.
