[باب ما يبطل به الشفعة] قال: "وإذا ترك الشفيع الإشهاد حين علم بالبيع وهو يقدر على ذلك بطلت شفعته" لإعراضه عن الطلب وهذا لأن الإعراض إنما يتحقق حالة الاختيار وهي عند القدرة.
