"وإن استحقه العامل أخذ قدر بذره وقدر أجر الأرض وتصدق بالفضل" لأن النماء يحصل من البذر ويخرج من الأرض، وفساد الملك في منافع الأرض أوجب خبثا فيه. فما سلم له بعوض طاب له وما لا عوض له تصدق به.
