"وإن امتنع الذي ليس من قبله البذر أجبره الحاكم على العمل" لأنه لا يلحقه بالوفاء بالعقد ضرر والعقد لازم بمنزلة الإجارة، إلا إذا كان عذر يفسخ به الإجارة فيفسخ به المزارعة.
