الْمَرْوِيّ عَن مُحَمَّد رَحمَه الله أَن كل مَكْرُوه حرَام إِلَّا أَنه لما لم يجد فِيهِ نصا قَاطعا لم يُطلق عَلَيْهِ لفظ الْحَرَام وَعَن أبي حنيفَة وَأبي يُوسُف أَنه إِلَى الْحَرَام أقرب وَهُوَ يشْتَمل على فُصُول مِنْهَا
