وَإِن كَانَ لَا يجوز أَن يعود إِلَيْهِ فَهُوَ كالموات إِذا لم يكن حريما لعامر

"وإن كان لا يجوز أن يعود إليه فهو كالموات إذا لم يكن حريما لعامر" ؛ لأنه ليس في ملك أحد، لأن قهر الماء يدفع قهر غيره وهو اليوم في يد الإمام.
