"وإن سقط بعد فراغهم فالضمان على رب الدار استحسانا" لأنه صح الاستئجار حتى استحقوا الأجر ووقع فعلهم عمارة وإصلاحا فانتقل فعلهم إليه فكأنه فعل بنفسه فلهذا يضمنه
