"وفي الاستحسان الضمان" "على المستأجر" لأن كونه فناء له بمنزلة كونه مملوكا له لانطلاق يده في التصرف فيه من إلقاء الطين والحطب وربط الدابة والركوب وبناء الدكان فكان الأمر بالحفر في ملكه ظاهرا بالنظر إلى ما ذكرنا فكفى ذلك لنقل الفعل إليه.
