(ولا يبطل البيع بجحوده) أي: جحود أحد العاقدين له،

فلو قال: بعتُك الأَمَة بكذا، فأنكر المشتري، لم يطأها البائع، لكن إن لم يبذل له الثمن فيتوجَّه له الفسخ، كما لو أعسر المشتري.
