(وإن أعلمه) بائع (بكيله ونحوه) كوزنه، وعدِّه، وذَرْعه (فقبضه) المشتري جزافًا (ثم باعه به) أي: بالكيل ونحوه الذي أخبره به البائع (لم يجز) أي: لم يصح البيع قبل اعتباره، لفساد القبض، لعدم علمه قَدْره.
