(بغيره ولم يتميَّز، لم ينفسخ) البيع؛ لبقاء عين المبيع (وهما) أي: المشتري ومالك ما اختلط به المبيع (شريكان في المختلط) بقَدْرِ ملكيهما، ولمشترٍ الخيار.
