(لكن يجب) على من تلف ذلك بيده قبل إقباضه (بـ) سبب (تلفه مثلُه) إن كان مثليًّا (أو قيمتُه) إن كان متقومًا؛ لأنه من ضمانه حتى يقبضه مستحقه إلحاقًا له بالمبيع (ولا فسخ) بتلف ذلك قبل قبضه.
