(فإن أبى الشريك الإذن) للبائع في تسليم الكل للمشتري (قيل للمشتري: وَكِّل الشريكَ في القبض) ليصل إلى مقصوده من قبض المبيع (فإن أَبى) أن يوكِّل، أو أَبى الشريك أن يتوكل (نصبَ الحاكمُ من يقبض) الكلَّ جمعًا بين الحقين (فيكون في يده لهما) أمانة أو بأجرة، والأجرة عليهما.
