(فإن علم المشتري ذلك) أي: أن للبائع شريكًا لم يأذن في تسليم حصته، وتلفت العين بيده (فقرار الضمان عليه) لحصول التلف بيده (وإلا) بأن لم يعلم أنه لم يأذن (فـ) قرار الضمان (على البائع) لتغريره للمشتري.
