(وإن ظهر) الغصب أو العيب من غير الجنس (في بعضه) بأن صارفه دينارين بعشرين درهمًا، فوجد أحد الدينارين مغصوبًا، أو به مِسٌّ (بطل العقد فيه فقط) بما يقابله، وصح في السليم بما يقابله.
