(ولا يتصرَّف في حقه) إذا قبضه بغير معياره الشرعي (قبل اعتباره) لفساد القبض، ويبرأ الدافع من ضمانه إذا تلف (ثم يأخذ) المستحق (قَدْرَ حَقِّه منه) أي: من المقبوض جزافًا ونحوه.
