(ولو صالح) الجاني (عن القصاص بعبدٍ أو غيره) كأمَةٍ ودار (فخرج) العبد (مستحقا، أو حرا) أو كانت الأمَة كذلك، أو الدار مستحقة أو موقوفة (رجع) وليُّ القصاص (بقيمته) أي: قيمة العبد أو نحوه؛ لتعذُّر تسليمه، فيرجع إلي بدله.
