(وإن صالحه على إجراء الماء في ساقيةٍ) أي: قناة (من أرض ربِّ الأرض مع بقاء ملكة) أي: ربّ الأرض (عليها) أي: أرض الساقية (فهو إجارة للأرض) لأنه بيع منفعتها بعوض معلوم
