(ولو صالحه على أن يسقي أرضه من نَهره، أو) من (عينه) أو بئره (مدة ولو معينة، لم يصح) الصلح (لعدم ملكه الماء) لأن الماء العِدّ لا يُملك بملك الأرض كما تقدم.
