(ولا يجوز) لأحد (أن يحفر في الطريق النافذة بئرًا لنفسه، سواء جعلها لماء المطر، أو استخرج منها ماء) عِدًّا (ينتفع به) ولو بلا ضرر؛ لأن الطريق ملك للمسلمين كلهم، فلا يجوز أن يحدث فيها شيئًا بغير إذنهم، وإذنهم كلهم غير مُتصوَّر.
