(وإن صدَّقه) أي: المدين (غريمُه) في دعوى الإعسار (لم يُحبس، ووجب إنظارُه) إلى ميسرة (ولم تَجُزْ ملازمته) ولا الحَجْر عليه، كما تقدم ، لقوله تعالى:{وَإِنْ كَانَ ذُو عُسْرَةٍ فَنَظِرَةٌ إِلَى مَيسَرَةٍ}.
