(ولا يحلف) مُدَّعي الإعسار (معها) أي: مع بينته الشاهدة بعُسرته (لأنه تكذيب للبينة، ويكفي في الحالين) أي: في حال شهادتها بالتلف، وحال شهادتها بالإعسار
