(ولو حكم حاكمٌ بكونه) أي: الذي وَجَدَ متاعه عند المفلس (أُسوة الغرماء نقض حكمه نصًّا (٢) ) قال أحمد: لو أن حاكمًا حكم أنه أُسوة الغرماء، ثم رفع إلى رجل يرى العمل بالحديث، جاز له نقض حكمه، ذكره في "المغني" و"الشرح".
