(ثم) يبدأ (بمن له رهن لازم) أي: مقبوض (فيختص بثمنه) إن كان قَدْر دينه، سواء كان المفلس حيًّا أو ميتًا؛ لأن حقه متعلِّق بعين الرهن وذمة الراهن، بخلاف الغرماء.
