فإن أمكنه أن يشتري بالمعزول أكثر ما قدر له لرخص المسلم فيه اشترى له بقدر حقه ويرد الباقي على الغرماء

(فإن أمكنه) أي: الحاكم، أو أمينه (أن يشتري بالمعزول) لربِّ السَّلَم (أكثر مما قُدِّرَ له) أي: من المعقود عليه (لرُخْصِ المسلَم فيه اشترى له) أي: لرب السَّلَم (بقَدْر حقِّه) أي: قَدْرِ سَلَمه (ويردُّ الباقي) مما خرج له بالمحاصة (على الغرماء) لأنه لا مستحق له غيرهم
