(ولا يملك الحاكم قبض ذلك) أي: ما ذكر من هبة وصدقة ووصية ونحوها للمدين (لوفائه) أي: وفاء دينه (بلا إذن) من المدين (لفظيٍّ، أو عُرفيٍّ) لأنه لا يملك إجباره عليه، فلم يملك فعله عنه.
