(وإن أقرَّ) المفلس (أنه) أي: المال (لغائب، أُقرَّ) المال (في يده) أي: المفلس (حتى يحضر الغائب، ثم نسأله) فإن صدَّقه، وحلف، أخذه، وإلا؛ أُعيد الحَجْر عليه (كما تقدم في الحاضر. وإذا انفك) الحَجْر
