(وإن أتلفوه، أو تلف في أيديهم) بتعدٍّ أو تفريطٍ، أو لا (لم يضمنوا، وكان من ضمان مالكه) لأنه سلَّطهم عليه برضاه، سواء (علم بالحَجْر، أو لم يعلم) لتفريطه.
